In anti-corruption case, Congress leader's BMWs seized

Mumbai:  The Economic Offences Wing (EOW) of the Mumbai police today sealed a bungalow belonging to former Mumbai Congress chief Kripashankar Singh after conducting searches at his residences and office, officials said. Mr Singh's two BMWs have also been seized.  

The raids that started late Thursday were conducted by a team of the EOW and a Special Investigating Team (SIT) at Singh's residences and office at various locations, including Vile Parle and Bandra in northwest Mumbai.

Official sources in the EOW said that Singh's bungalow, named "Tarang" in upmarket Bandra, has been sealed off. The sources also stated that the EOW is likely to attach other properties owned by Singh by late Friday.

The raids came barely 48 hours after Mumbai police registered a case against Singh and his family under the Prevention of Corruption Act and for other charges.

The Bombay High Court last week ordered the cases to be filed after hearing a Public Interest Litigation (PIL) of social activist Sanjay Tiwari.

Following the court directions, the SIT lodged a First Information Report at Nirmal Nagar police station in Mumbai's Khar on February 29.

The SIT was directed to probe the assets accumulated by Singh and his family following the allegations in Tiwari's PIL and the state Anti-Corruption Bureau's report of March 30, 2011, detailing the assets accumulated by Singh and his family members.

Accordingly, the SIT would probe all the movable and immovable assets of Singh and family, including land, flats, shops, bungalows, commercial premises, vehicles, bank accounts etc.

Singh resigned from the coveted post of the Mumbai Congress chief Soon after the high court order last week.

Singh, however, remained untraceable even as the Supreme Court Friday refused to hear his plea. The top court discovered that the plea, that was originally sought to have been listed March 1, was later listed for March 2.

Diary detailing love affair, jealousy holds clues to Shehla Masood's murder

Bhopal:  The diary of Zahida Parvez, an interior designer from Bhopal arrested this week, may nail its author for the murder of Shehla Masood. In August last year, Ms Masood, a Right to Information activist who was well-known in Bhopal, was found dead in her car outside her home.  The CBI believes that Ms Parvez, seized by jealousy, hired a hit-man to assassinate the activist.
Ms Masood was known locally for her close ties to different BJP politicians. One of them, an MLA named Dhruv Narayan Singh, was allegedly romantically involved with the interior designer.  Ms Parvez's diary, with entries in Hindi and Urdu, documents her relationship with the MLA, as well as her escalating suspicions over the nature of his friendship with Ms Masood.  She allegedly tracked the MLA's phone bills closely to keep tabs on his private life. In the diary, recovered by investigators from her office, she wrote in March last year, "Either, I will commit suicide or I will kill those who are close to Dhruv.'
The CBI believes that she then befriended a local contract killer who in turn hired the men who actually shot Ms Masood.
In her diary, on the day of the murder, Ms Parvez writes that she received a phone call from the contract killer who said "Congratulations, the work has been completed in front of the house."
More evidence against the interior designer could come from a friend of hers named Saba Farooqui who was also arrested today.  Accompanied by her friend, Ms Parvez allegedly stalked the MLA; one day, her diary shows, she saw him entering Ms Masood's home.
The dead activist's father, Masood Sultan, says that to the best of his knowledge, his daughter did not know the woman arrested for her murder.  He also acknowledges that Mr Singh was a frequent visitor to his home.  He told NDTV today that the MLA was the first person he called after he learnt his daughter had been killed.  "He just kept quiet," he recalled. "I expected him to ask for details but he did not. Then he came to the house to offer his condolences. After that he never came to meet us," he said.

Mr Singh has been interrogated by the CBI.

Dia Mirza admits that most of her conversations now revolve around tying the knot with fiancé Sahil Sangha. “People only talk about my wedding,” she says with a laugh, adding, “When they ask me when we’re getting married, I reply, ‘where is the ring?” But the actor admits that Sangha,
too, has marriage on his mind. “The other day, while we were driving somewhere, he suddenly asked me if I wanted a destination wedding. I was so surprised, I nearly fell out of the car,” she says, adding, “I said, ‘give me the ring first, then we’ll talk about the wedding.’”

On a serious note Mirza admits she’s looking forward to having an intimate ceremony. “Sahil comes from a very big family, while mine is very small. I just want an intimate wedding, surrounded by the people I wouldn’t want to get married without.”

What’s more, the actor’s trousseau might just give her a chance to venture into a new field — designing. “I have so many close designer friends, that I’ll be in such a dilemma when I have to chose my wedding outfit. Maybe the first thing I should design is my wedding dress,” she says.

The actor, who is currently working on three new production ventures simultaneously, will walk the ramp today for designer Khushali Kumar at Lakme Fashion Week. She admits the bejewelled collection tempted her to return as showstopper.

Ask her whether she’s still racked by nerves when she hits the runway, and Dia responds, “Completely. There’s something about being on stage with all the attention focussed on you that gives you an adrenaline rush. I’m smiling, but in my head, I’m begging ‘God, please don’t let me slip.’”

2G: Govt seeks review of verdict questioning policy

New Delhi:  The government today moved the Supreme Court questioning its verdict holding the policy of first-come-first-served in 2G spectrum allocation as unconstitutional while cancelling 122 licences saying it has entered into the exclusive domain of the executive and beyond the limits of judicial review.

The review petition contended the top court's prescription of a single method for distribution of all natural resources, including spectrum, through "auction" route is contrary to the principle of separation of powers embodied in the Constitution.

The government said the February 2 judgement cancelling the 2G licences "is liable to be reviewed since there are errors which are apparent on the face of the record" and there are other sufficient reasons for reviewing the verdict delivered by a bench of justices G S Singhvi and A K Ganguly (since retired).

While pointing out flaws in the policy of auction, the petition said there was error in the judgement that State is duty bound to follow this procedure in all cases, as no reasonable authority could hold that in all cases, natural resources must go to the highest bidder.

The government also questioned the top court for interfering into the policy decision and said the judgement in respect of the policy is "directly contrary to the settled law."

It said the remarks made in the judgement that the policy of first-come-first-served adopted in the 2G spectrum was "lopsided" and "flawed" and was not in public interest needs reconsideration.

Quoting several top court judgements, the petition said "the essence of policy-making and governance is the weighing and balancing of different values and considerations, which is the role of the executive, and it is not permissible for the court to take this exercise upon itself and engage in policy-making, both for the reason that it is not its role to do so and it does not have the expertise to do so."

"For that, the court travelled beyond the established limits of judicial review and entered the exclusive domain of the executive when it held in the impugned judgment that the policy was flawed on the ground that the court disagreed with the weight attached by the executive to the different factors underlying the decision to adopt the policy," the petition said.

The government submitted the Supreme Court had erred in holding the first-come-first-served policy as "flawed" and "lopsided" as the considerations of maximizing short-term revenue for the state outweighed promoting growth, affordability, penetration of wireless services in semi-urban and rural areas, as well as maintaining a level-playing field between existing and new licensees for 2G spectrum.

It said that in holding the policy to be not in public interest, the court's finding was "entirely contrary to the jurisprudence of judicial review, which does not permit a court to hold a policy decision to be flawed only because the court has a different view from that of the executive of what lies in public interest."

Further, the government said that within the limited scope of a judicial review, the court "ought not to have disapproved of the policy on the ground that the state could have earned greater revenue by following a different policy."

Bangalore lawyers attack reporters with stones, iron chairs

Bangalore:  For about 60 minutes this morning, media crews outside a Bangalore court tried to duck stones, helmets, iron chairs all being flung at them by a group of nearly 500 lawyers. The riot lasted for an hour and subsided after the police resorted to a lathi-charge and tear-gassing. Ten journalists, most of them cameramen, are recovering in different hospitals in the city. Seven lawyers and 30 policemen were also injured.

"They attacked me with huge stones, they tried to take away my camera," said Mr Nagesh, a reporter with a local TV channel.

The lawyers say this was their protest against what they describe as one-sided coverage of their strike in January.   Lawyers had blocked one of the main roads near the city centre to protest against police assault against a colleague.  The protest had led to a seven-hour traffic nightmare in the heart of  Bangalore, provoking extensive media coverage.

Former minister Janardhana Reddy, arrested for illegal mining by the firms he owns in Bellary, was bring brought to court today, ensuring a huge turnout of reporters.
Chief Minister Sadananda Gowda says a judicial inquiry will identify those responsible for the worst of the violence.   The police is using the footage of news channels to find the culprits. Section 144 which bans people from assembling in groups has been imposed in the court area which is meters away from the Vidhan Soudha.

"The festival will celebrate Indian cinema and create bonds of greater understanding and experience between the communities of Victoria and India," he added.

The 10-day festival will take place in mid-2012 and showcase the depth and diversity of the Indian film industry.

Louise Asher, minister for innovation, services and small business, said India is one of the largest film industries in the world and it makes sense to develop ties between our film industries.

"The festival complements a range of initiatives to develop ties between the Victorian and Indian film industries, including a Victoria/India Co-production Initiative which will see ten Victorians travel to FICCI Frames in Mumbai in March," Asher said.

"The initiative will also support up to three Victorian companies to develop a feature film, television or digital media project as a joint venture with a production entity based in India," she added.

China denies dam drying up river in India

Beijing:  China denied on Friday that a dam it was building on a major river in Tibet was impacting the lower reaches of the waterway in India, despite complaints that water-levels there were plunging.

The Brahmaputra has its source in China's southwestern Tibet region where it is known as the Yarlung Tsangpo, and it enters India in the mountainous, remote northeastern state of Arunachal Pradesh, where it is called the Siang.

The 1,800-mile (2,900 kilometre) river then descends into the plains of adjoining Assam state and ends in Bangladesh in the Bay of Bengal, along the way supplying water to hundreds of millions of farmers and residents.

Local Indian state lawmaker Tako Dabi told AFP on Thursday he suspected China was diverting river water resulting in an estimated 40 percent drop in the flow at the Indian town of Pasighat.

"Our projects have not affected the lower stream regions, including those in India," China's foreign ministry spokesman Hong Lei told reporters when asked of his nation's water usage on the river.

"Overall, the utilisation of the river by the Chinese side is very low."

China pays attention to the impact on the lower stream regions when developing its water resources, Hong said, adding that Chinese officials have briefed India on its development of the Yarlung Tsangpo.

"To satisfy the needs the Tibet Autonomous Region, China has begun to build the hydroelectric power station of Zangmu in the middle part of Yarlung Tsangpo river," Hong said.

"It does not have a big capacity and does not retain an excessive amount of water. It will not affect the downstream water regulation and environment."

Beijing has regularly faced similar complaints over its water usage from Southeast Asian nations for damming the Mekong and Salween rivers, both of which originate in China.

Dabi said the drying up of the river in Arunachal Pradesh was shocking with patches of sand showing up along the river bed.

"We suspect the sudden drying up of the Siang could be a result of China either diverting the river water on their side or due to some artificial blockades somewhere in the upper reaches,"

Dabi, an advisor to the state's chief minister and a former home minister, said.

Video footage from the river showed the Siang -- normally a gushing torrent several kilometres (miles) wide at Pasighat, according to Dabi -- reduced to flowing in narrow channels in a large sandy riverbed.

The problem was highlighted on the day the Chinese Foreign Minister Yang Jiechi held talks in New Delhi with his Indian counterpart S.M. Krishna.

Yahoo India no longer among internet firms facing criminal charges

New Delhi:  Yahoo India has been dropped from the list of 22 companies facing criminal charges in a Delhi court.  The firms - which include Google, Facebook and YouTube - have been taken to court by journalist Vinay Rai over morphed and obscene photos.  The firms have been accused of conspiring to distribute lascivious content.
But the Delhi High Court today accepted Yahoo's petition that said the lower court had wrongly included it in the list of companies that should be tried; the lawyer for Yahoo! argued that there were no documents to support Mr Rai's allegation against the website for violation of any law.
The High Court accepted that, but warned that the case against Yahoo! could be revived "if credible and actionable pieces of evidence are filed against It."
The lower court judge who has summoned executives of the companies in March; some, like Facebook, have applied for and been granted exemption.
The same internet companies are also dealing with a separate civil suit in another Delhi court where they have been accused of hosting material that allegedly provokes communal hatred and religious intolerance.  Yesterday, the court handling that case agreed that Microsoft should be dropped from the trial after Microsoft argued that the content in question had never been served by it.

Yes, was under pressure to resign after Supreme Court verdict, says Army Chief

New Delhi:  Army Chief General V K Singh, who lost his battle with the Defence Ministry on the age row, feels the Supreme Court has "not effectively" closed the issue but ruled out his resignation.

"It would be dishonest to say that that I was not under pressure to resign.  Even my closest advisors were affected by the media interpretation and, yes, I was extremely disappointed that the Supreme Court had not effectively closed the issue.

"... as chief of army staff, I have a responsibility towards the army and its men and have to attend to the unfinished tasks that I had set out for myself.  I cannot quit until I complete what I have started. Organisational interests are supreme," he told "Outlook" magazine in an interview.

General Singh said many commentators were looking at this matter as a classic case of strained civil-military relations, and drew parallels with the unfinished resignation of General K S Thimmayya, to predict his resignation.

"But I see the age as something that I and the army have to address, and we will do it once we are given a legal order," he said in reply to a question about the wide speculation that he would resign since the Supreme Court did not uphold his case.

General Singh said the apex court order has created more confusion, without addressing the main issue. It talks of a statutory complaint being divided into two parts--the process of decision-making on the one hand and maintainability on the other.

"The Ministry of Defence (MoD) has argued that since the decision has been taken by them to peg my Year of Birth as 1950, I must accept this regardless.  This goes against the principles of natural justice," General Singh said.

Asked about the impression that he had lost the battle and that the Supreme Court had ruled against him, he said it was a strange situation.

While the apex court was dealing with the case there was a parallel minute-by-minute interpretation of the proceedings in the media.  Breaking news on TV and newspaper headlines the next day delivered their own verdict which declared that 'the General has lost the battle'.

But, he said, when the order came out on February 15, the media did not report it and everyone missed its import. "It is an innocuous order that leaves recognition of the DoB to the competent authority based on records.  The media was reporting obiter dicta in a highly exaggerated manner," he said.

To a question about his decision to withdraw the petition in the court gave an impression that he was satisfied with what the court had to say, General Singh said after his statutory complaint was rejected the Defence Ministry on December 30 last, he had moved the court.

On February 3, the court questioned the decision-making process which led to it being turned down and opined that it went against the principles of natural justice.

On February 10, the Attorney General withdrew the Defence Ministry's order against the statutory complaint and tacitly admitted that the actual DoB was 1951 and that the ministry was opposing it only "on a matter of principle".

General Singh said after that there was nothing else to be said in court especially since the judges had also indicated that the court did not want to get into the actual date of birth.

"Now, unless the Defence Ministry's decision-making process is spelt out so as to explain the rationale behind still pegging my YoB as 1950, how can I challenge it. I therefore withdrew my petition and have decided to wait for the MoD to give its reasons afresh," he said.

He said it is important to put in place systems that ensure that such cases were never repeated in future.

Asked about the views of his daughter who wrote in an article pointing at the hand of former chief General J J Singh in the DoB controversy, General Singh gave no direct answer except to say that the problem got aggravated when the Defence Ministry chose to "endorse this line without going into why this was being done".

Q: Are you saying that the 2006 decision (taken by J J Singh) was illegal?

A: It has its ramifications. Even I say that I don't contest it, it cannot be implemented because the SC order does not say anything about the legality of two different dates of birth.

To a question he was looked upon as someone standing up to the establishment, giving as good as he got, General Singh said, "being Chief of the Indian Army does not insulate me from public opinion and I am aware that many feel that I was wrong in taking the fight to the MoD".

He said the tendency after reaching senior ranks is to avoid rocking the boat. "But if I, as the chief, did not stand up for what is correct, what sort of a message would I be sending to the rank and file," he said.

Similarly, he said, that despite the overwhelming opinion he should resign, it was necessary for him to stay the course.

"The SC has sidestepped the issue. But it certainly does not clear the way for any illegal order to be given to the Army. Had I resigned, it would have been a self-goal and in the long run, against the interest of the organisation," General Singh said.

Department will be RGV's most stylish film: Rana Daggubati

Ram Gopal Varma's past few projects have failed to rock the box office, but actor Rana Daggubati, who has teamed up with the director in Department, is confident that the film will turn out to be one of his most stylish movies.

"Ramu (Varma) dabbles in a lot of genres of films. He is very good with his work, and has a wonderful storytelling pattern, which is most often trendsetting. His film Satya broke stereotype, and Company gave Vivek Oberoi such a great launchpad...I think Department will be one of his most stylish film ever shot," Rana told IANS.

In Department, the southern star will be seen as a grungy policeman - a role that was earlier reserved for Abhishek Bachchan. The film's characters include a don, a gangster, a gangster-turned-politician, and shootout specialists. No wonder it was exciting for Rana to work in it!

"I think Ramu is one filmmaker who has complete understanding of the subject he tackles in his films and likes to accumulate extensive knowledge before venturing out into each theme. Be it underworld or any other subject, his films speak of the research he does.

"Usually Ramu shoots his films quickly, but he has spent a lot of time on Department, which is great. It's a project close to him, and it has been a fantastic experience working with him," he added.

Rana, who made his Bollywood debut in Dum Maro Dum, will be seen with Amitabh Bachchan and Sanjay Dutt in the movie, releasing May 18.

He is also upbeat about the action sequences in the film.

"Department is a heavy-duty action film. I trained a lot for it, and the training was just in the gym. It had a lot to do with marshall arts, and I easily had 10 to 15 action sequences. So it was fun," said the 27-year-old.

Meanwhile he has also been occupied with the dubbing of Telugu film Naa Ishtam, in which he is paired opposite the recently-married Genelia D'Souza.

"I play a young, brash boy in Naa Ishtam....very different from Department, in which each line that my character says, is measured. Naa Ishtam is a commercial project...I am playing my age, and it was wonderful to work with Genelia. She is way more experienced than I am, but we had a great time," said the actor, who enjoys the diverse content offered to him.

"I made an unconventional debut with Dum Maro Dum. As a launch film, it was different as opposed to others, who would go for a romantic project. So I am happy," he added.

Mumbai, Feb. 29 -- Shekhar Suman's popular '90s TV show Movers & Shakers (M&S) returns with season 2 after almost a decade. Starting March 12, it is being planned as a mix of existing formats like The Tonight Show with Jay Leno and hit US sketch show, Saturday Night Live.

Shekhar says, "On the show, I voice the common man's opinion and views. We will discuss politics, the economy and entertainment, making it topical." The previous season of the show, which ended in 2001, ran for three years on Sony TV and featured over 1,500 celebs from all walks of life. It will now be aired on SAB TV.

"It feels like a second honeymoon, like coming home and revisiting a friend. We have made some changes in the format with more celebs, and even clips from old episodes of M&S to see how the celebs and I have changed over the last 10 years," adds Shekhar.

The show will also have segments like film analysis, Shekhar's gags, a stand-up comedy act, along with a 10minute chat with the famous guests. "It will be a compact show, and I am keen to have new celebrities, as well as the ones I had in the earlier season. We plan to get Anna Hazare for the first episode. He represents the common man and is a righteous person. Firebrand politician Raj Thackeray is another person on our list," reveals Shekhar, adding they will need 22 celebrities every month.

Rajasthan police arrest paraplegic woman they allegedly tortured earlier

Jaipur:  In a case that has sent shockwaves through Rajasthan and made national headlines, police in Jaipur have arrested a paraplegic woman. The 22-year-old girl is charged with abetting the abduction and sexual abuse of another woman.

But the arrested woman was herself allegedly a victim of sexual abuse by policemen in January last year. She was allegedly thrashed and molested by three police men in Jaipur. She then tried to commit suicide; an attempt that left her without the use of both her legs and 80 per cent paralysed.

Women's group say yesterday's arrest is an attempt to save those policemen, who are now in jail. "She has been arrested only to weaken the case against the policemen, demoralize her and break the witnesses in her case. This arrest is really shameful," said Kavita Srivastav, General Secretary of People's Union of Civil Liberties, Rajasthan.

Her mother says she is completely bed ridden and needs constant care. She says the police forced the other victim to name her daughter in the case in an attempt to save their colleagues. "The police has been pressurising us to compromise in this case. They have also been threatening us. In the exploitation of the other girl, my daughter had no role at all.  

But the police refute the charges and say the arrest was made on the basis of a complaint. The complainant had alleged that the 22-year-old paraplegic had conspired in her abduction and repeated sexual exploitation by six men last year. "The Court had constituted a Medical Board to examine her condition. The Medical Board found that she is mentally fit though physically disabled. On that basis we questioned her and after that as she is an accused in that case we had to arrest her," said Deputy Commissioner of Jaipur Police, Mahendra Singh.

A lower court has rejected her bail plea. She is being kept in the Sawai Man Singh hospital in Jaipur.

The Rajasthan High court will now decide whether to give her bail. If she's sent to jail, this victim of sexual abuse will face the trauma of staying on the same premises where the policemen who tormented her are already lodged.

Shiv Sainiks police film set to ensure no foreigners

Mumbai:  There were some unexpected guests on the sets of Tezz at Filmistan Studios yesterday.  A couple of Shiv Sainiks arrived to check on the foreigners who were present for the shoot.

Mallika Sherawat, who is doing an item number Laila in the movie, was shooting when the Shiv Sainiks arrived. The film stars Ajay Devgn, Anil Kapoor, Zayed Khan, Kangna Ranaut and Sameera Reddy.

A unit source said, "They (Shiv Sainiks) said that they would not allow foreigners to shoot for a Hindi movie in Maharashtra."

The source adds, "The production head explained to them that the foreigners were there for a couple of shots that would be wrapped up in just an hour."

But according to an insider, "The production personnel told the Shiv Sainiks that there were no foreigners on the sets. The dancers present were all members of their respective association.

It was just that since the film's story is set in London, we had a couple of foreigners playing cops coming to check the pub for Ajay and Zayed's characters, while Mallika is performing."

Fortunately for the Tezz team, the issue was sorted out by late afternoon. "After we had finished couple of shots featuring the foreigners, they left. And the shoot continued as normally as before," informs the unit source.

Producer Ratan Jain confirmed that some Shiv Sainiks had arrived on the sets. "My people spoke to them and it was sorted out. The shoot is going on and will be wrapped up in three days."
